USER AGREEMENT FOR ONLINE PURCHASES ON DESICHE.SHOP This User Agreement ("Agreement") governs your use of the website desiche.shop ("Website") operated by Iris N Bravo Co. ("INB", "we", "our", or "us"). By creating an account, accessing, or purchasing through the Website, you agree to be bound by the terms of this Agreement. 1. DEFINITIONS • "User" or "Customer": Refers to any individual or entity registering or making a purchase on the Website. • "Website": Refers to desiche.shop and any associated platforms operated by INB. • "Products": Goods listed for sale on the Website. • "Order": A confirmed request by the User to purchase Products from the Website. • "Personal Data": Any information that identifies or relates to a User, as outlined in our Privacy Policy. 2. ACCOUNT CREATION AND RESPONSIBILITIES • 2.1 Users must provide accurate and complete information during account creation and are responsible for maintaining the confidentiality of their account details. • 2.2 INB reserves the right to terminate accounts without notice if the User violates this Agreement or engages in unauthorized activities. • 2.3 The User agrees not to use false information or impersonate any individual or entity when registering or purchasing through the Website. 3. PURCHASE TERMS • 3.1 All Orders are subject to availability and acceptance by INB. • 3.2 Prices listed on the Website are in UAE Dirhams (AED) and inclusive of applicable taxes unless stated otherwise. • 3.3 INB reserves the right to cancel any Order at its discretion. In such cases, any payment made by the User will be refunded. • 3.4 Users are responsible for ensuring the accuracy of the delivery address provided at the time of purchase. INB is not liable for delays or non-delivery resulting from incorrect or incomplete information. 4. RETURNS, REFUNDS, AND DISPUTES • 4.1 Returns or refunds will be processed in accordance with our Return Policy, available on the Website. • 4.2 Users must provide accurate and sufficient evidence when initiating a return or refund claim. Misrepresentation may result in denial of the claim. • 4.3 Disputes regarding Products or services must be submitted to INB within 14 days of delivery. INB will endeavor to resolve disputes amicably but reserves the right to make a final determination. 5. USER OBLIGATIONS • 5.1 Users agree not to: • Misuse the Website or engage in activities that harm its functionality. • Submit fraudulent or misleading information. • Attempt to bypass security measures or access unauthorized areas of the Website. • Use the Website for unlawful purposes. • 5.2 Users agree to indemnify INB against any claims, damages, or losses arising from their misuse of the Website or violation of this Agreement. 6. PRIVACY • 7.1 INB collects and processes Personal Data in accordance with its Privacy Policy, available on the Website. • 7.2 By using the Website, Users consent to the collection and use of their data as described in the Privacy Policy. 8. LIMITATION OF LIABILITY • 8.1 INB provides the Website and Products on an "as is" basis without warranties of any kind, express or implied. • 8.2 INB is not liable for: • Delays or failures caused by circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, or system outages. • Indirect, incidental, or consequential damages arising from the use of the Website or Products. • 8.3 INB’s total liability for any claim shall not exceed the amount paid by the User for the relevant Order. 9. GOVERNING LAW AND DISPUTE RESOLUTION • 9.1 This Agreement shall be governed by the laws of the United Arab Emirates. • 9.2 Any disputes arising out of or in connection with this Agreement shall be resolved amicably. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of the UAE. 10. GENERAL • 10.1 INB reserves the right to update or amend this Agreement at any time. Users will be notified of significant changes via email or Website announcements. • 10.2 Continued use of the Website after changes to the Agreement constitutes acceptance of the revised terms. • 10.3 This Agreement constitutes the entire agreement between the User and INB, superseding any prior communications. ("INB"، "نحن"، "خاصتنا"). من خلال إنشاء حساب، أو الدخول إلى الموقع، أو الشراء عبره، فإنك توافق على الالتزام بشروط هذه الاتفاقية. ١. التعريفات ١.١ "المستخدم" أو "العميل": يشير إلى أي فرد أو كيان يقوم بالتسجيل أو الشراء على الموقع. ١.٢ "الموقع": يشير إلى desiche.shop وأي منصات مرتبطة تديرها INB. ١.٣ "المنتجات": السلع المدرجة للبيع على الموقع. ١.٤ "الطلب": طلب مؤكد من المستخدم لشراء المنتجات من الموقع. ١.٥ "البيانات الشخصية": أي معلومات تُحدد هوية المستخدم أو تتعلق به، كما هو موضح في سياسة الخصوصية الخاصة بنا. ٢. إنشاء الحساب والمسؤوليات ٢.١ يجب على المستخدمين تقديم معلومات دقيقة وكاملة عند إنشاء الحساب، ويتحملون مسؤولية الحفاظ على سرية بيانات حسابهم. ٢.٢ تحتفظ INB بالحق في إنهاء الحسابات دون إشعار إذا خالف المستخدم هذه الاتفاقية أو قام بأنشطة غير مصرح بها. ٢.٣ يوافق المستخدم على عدم تقديم معلومات خاطئة أو انتحال هوية أي فرد أو كيان عند التسجيل أو الشراء عبر الموقع. ٣. شروط الشراء ٣.١ جميع الطلبات تخضع لتوفر المنتجات وقبول INB. ٣.٢ الأسعار المدرجة على الموقع بالدرهم الإماراتي (AED) وتشمل الضرائب المطبقة ما لم يُذكر خلاف ذلك. ٣.٣ تحتفظ INB بالحق في إلغاء أي طلب حسب تقديرها. وفي هذه الحالات، سيتم رد أي مدفوعات قام بها المستخدم. ٣.٤ يتحمل المستخدم مسؤولية التأكد من صحة عنوان التسليم المُقدم عند الشراء. ولا تتحمل INB المسؤولية عن التأخير أو عدم التسليم الناتج عن معلومات غير صحيحة أو غير كاملة. ٤. الإرجاع، الاسترداد، والنزاعات ٤.١ تتم معالجة عمليات الإرجاع أو الاسترداد وفقًا لسياسة الإرجاع المتوفرة على الموقع. ٤.٢ يجب على المستخدمين تقديم أدلة دقيقة وكافية عند تقديم طلب إرجاع أو استرداد. قد يؤدي التزوير إلى رفض الطلب. ٤.٣ يجب تقديم النزاعات المتعلقة بالمنتجات أو الخدمات إلى INB خلال ١٤ يومًا من التسليم. ستسعى INB لحل النزاعات وديًا، لكنها تحتفظ بالحق في اتخاذ القرار النهائي. ٥. التزامات المستخدم ٥.١ يوافق المستخدمون على عدم: - إساءة استخدام الموقع أو القيام بأنشطة تضر بوظائفه. - تقديم معلومات احتيالية أو مضللة. - محاولة تجاوز تدابير الأمان أو الوصول إلى مناطق غير مصرح بها في الموقع. - استخدام الموقع لأغراض غير قانونية. ٥.٢ يوافق المستخدمون على تعويض INB عن أي مطالبات أو أضرار أو خسائر تنشأ عن إساءة استخدام الموقع أو انتهاك هذه الاتفاقية. ٦. حقوق الملكية الفكرية ٦.١ جميع المحتويات والعلامات التجارية وحقوق الملكية الفكرية على الموقع مملوكة لـ INB أو المرخصين التابعين لها. يُمنع نسخ أو توزيع أو تعديل أي محتوى بدون إذن خطي صريح. ٦.٢ لا يجوز للمستخدمين استخدام اسم INB أو شعارها أو علامتها التجارية بدون موافقة مسبقة. ٧. الخصوصية ٧.١ تقوم INB بجمع ومعالجة البيانات الشخصية وفقًا لسياسة الخصوصية الخاصة بها المتوفرة على الموقع. ٧.٢ باستخدام الموقع، يوافق المستخدمون على جمع بياناتهم واستخدامها كما هو موضح في سياسة الخصوصية. ٨. تحديد المسؤولية ٨.١ تقدم INB الموقع والمنتجات كما هي، دون أي ضمانات من أي نوع، صريحة أو ضمنية. ٨.٢ لا تتحمل INB المسؤولية عن: - التأخيرات أو الفشل الناتج عن ظروف خارجة عن سيطرتها، بما في ذلك على سبيل المثال لا الحصر الكوارث الطبيعية أو الإجراءات الحكومية أو انقطاع النظام. - الأضرار غير المباشرة أو العرضية أو التبعية الناتجة عن استخدام الموقع أو المنتجات. ٨.٣ لا تتجاوز المسؤولية الإجمالية لـ INB عن أي مطالبة المبلغ الذي دفعه المستخدم للطلب المعني. ٩. القانون الحاكم وحل النزاعات ٩.١ تخضع هذه الاتفاقية لقوانين دولة الإمارات العربية المتحدة. ٩.٢ تُحل أي نزاعات تنشأ عن هذه الاتفاقية وديًا. وإذا لم يتم حلها، تُحال إلى الاختصاص القضائي الحصري لمحاكم الإمارات. ١٠. أحكام عامة ١٠.١ تحتفظ INB بالحق في تحديث أو تعديل هذه الاتفاقية في أي وقت. سيتم إخطار المستخدمين بالتغييرات المهمة عبر البريد الإلكتروني أو إعلانات الموقع. ١٠.٢ يُعتبر استمرار استخدام الموقع بعد تغييرات الاتفاقية قبولًا للشروط المعدلة. ١٠.٣ تمثل هذه الاتفاقية الاتفاق الكامل بين المستخدم وINB، وتلغي أي تواصلات سابقة.
